With this in mind, FORTITUDE ensures the privacy of Website users and all other Data Subjects, having adopted internal measures that are considered appropriate in order to protect the personal data being processed.
The provision of personal data while navigating the Website, when applicable, is subject to the express knowledge and acceptance of this Policy. “Personal data” is any information, of any nature and regardless of its form, relating to an identified or identifiable natural person (‘data subject’), where an “identifiable natural person” is one who can be identified, directly or indirectly, in particular by reference to identifiers such as names, identification numbers, location data or even personal contacts. The operation or set of operations which are performed on personal data or on sets of personal data, whether or not by automated means, such as activities of collection, recording, storage, adaptation or alteration, consultation, use, disclosure by transmission, dissemination or otherwise making available, and destruction, are defined as “data processing operations”.
As a visitor to our Website, you can navigate anonymously without an automatic registration of any form of Personal data, and you do not need to provide any personal information. Therefore, FORTITUDE will only process your personal data, namely your name and contact information, if and when you wish to communicate with us through the Website (e.g. requests for information, suggestions, complaints), for the purpose of managing and responding to said communication, and always based on your consent.
For the purposes of this processing activity, FORTITUDE is the controller of your personal data and will process it only for the strictly necessary period of time to manage and reply to your message.
Under the applicable legislation, you may, at all times, request access to the data concerning you, as well as their rectification, erasure, restriction of processing and portability, via a written request to FORTITUDE through the contacts indicated below. Additionally, you have the right to withdraw your consent at any time, although that withdrawal does not compromise the processing previously carried out on the basis of your consent. Finally, without prejudice to any other administrative or judicial action, you can always submit a complaint to the competent data protection authorities, namely the National Data Protection Commission (Comissão Nacional de Proteção de Dados – “CNPD”).
As a rule, FORTITUDE will not transfer nor share your personal data with third parties, unless required to do so: (i) due to legal or regulatory requirements, (ii) to comply with legal obligations or judicial orders, (iii) by determination of the CNPD or any other competent supervisory authority, or (iv) by request of a public or governmental authority.
