Alternative Dispute Resolution
(ADR)
Fortitude Capital – Sociedade de Capital de Risco, S.A. hereby informs its clients and unitholders that, in its capacity as a signatory institution, it has entered into a protocol with the Portuguese Securities Market Commission (CMVM) to promote Alternative Dispute Resolution (ADR) mechanisms.
1. Scope and Limits
This mechanism is intended for non-professional investors (consumers) for the resolution of disputes arising within the scope of the management of collective investment undertakings or authorized ancillary activities.
- Maximum amount in dispute: €30,000.
2. Dispute Resolution Entities
Fortitude Capital has joined the Consumer Arbitration Network, which comprises the following seven arbitration centers providing nationwide coverage:
- CACRC: Coimbra Region Consumer Conflict Arbitration Center.
- CACCL: Lisbon Consumer Conflict Arbitration Center.
- TRIAVE: Ave, Tâmega, and Sousa Consumer Conflict Arbitration Center.
- CICAP: Porto Consumer Information and Arbitration Center.
- CIAB: Consumer Information, Mediation, and Arbitration Center.
- CIMAAL: Algarve Consumer Information, Mediation, and Arbitration Center.
- CNIACC: National Center for Consumer Conflict Information and Arbitration.
3. Access Conditions
Recourse to these ADR mechanisms is only available when the investor’s claim has not been fully satisfied following:
- A complaint filed directly with Fortitude Capital; and
- A complaint filed with the CMVM.
